Our Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your use of database reactivation, outreach, verification, and related administrative services (“Services”) provided by Ntegrity 1st Advisors (“Company,” “we,” or “us”). By engaging our Services, you acknowledge and agree to these Terms.

2. Eligibility and Authorization
Clients represent that they have full legal authority to provide, transfer, and authorize the processing of all data shared with the Company. Clients affirm that any data submitted—whether customer, claimant, account holder, or lead data—has been lawfully obtained and may be lawfully reactivated under applicable privacy and data governance laws.

3. Compliance Obligations
The Company operates in accordance with U.S. federal and state standards governing consumer contact, data privacy, and records management. This includes but is not limited to compliance with:
- Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- Fair Credit Reporting Act (FCRA) where applicable
- State privacy acts, including CPRA, CPA, VCDPA, CTDPA, and other active state-level data regulations
- FTC regulations concerning deceptive or unfair business practices
- Do-Not-Call (DNC) registry requirements and exemptions

Clients must provide accurate compliance instructions and confirm lawful grounds for processing all submitted records.

4. Data Handling and Security
We safeguard data using industry‑recognized administrative, physical, and technical controls. Data is stored, processed, and transferred solely for the purpose of fulfilling agreed‑upon Services. The Company does not sell, lease, or use client data for external commercial purposes. Data retention periods are limited to operational necessity unless otherwise contractually arranged.

5. Client Responsibilities
Clients agree to:
- Supply data in secure, readable formats.
- Verify that all contact information provided is lawful for outreach.
- Notify the Company promptly of any data changes, restrictions, or revocation of processing rights.
- Maintain backups of all submitted data.

6. Service Scope
Database reactivation includes outreach, verification, updating of dormant records, claimant or customer contact, and associated reporting. Exact deliverables may vary based on contractual agreements and regulatory limitations.

7. Communication Methods
Outreach may occur via phone, email, SMS, postal mail, or digital messaging systems, consistent with legal restrictions. Clients authorize the Company to contact subjects within the legal and contractual scope defined.

8. Fees and Payment Terms
Service fees, schedules, and payment deadlines are defined in the executed Service Agreement or SOW. Late or incomplete payments may result in suspension of Services.

9. Limitations of Liability
The Company is not liable for:
- Inaccuracies in client‑submitted data
- Delays caused by regulatory constraints, third party systems, or client inaction
- Lost revenue, indirect damages, or consequential losses
Liability, where legally required, is limited to the total amount paid for the specific Service provided.

10. Confidentiality
Both parties agree to protect confidential information from disclosure except where required by law. This includes data, internal methodologies, and proprietary materials.

11. Termination
Either party may terminate Services with written notice, subject to any contractual terms. Upon termination, the Company will securely return or destroy client data per instructions and legal requirements.

12. Dispute Resolution
Disputes will be resolved through negotiation. If unresolved, they may proceed to mediation or arbitration under applicable state law. Venue is determined by the Service Agreement.

13. Amendments
We may update these Terms to reflect regulatory or operational changes. Continued use of Services constitutes acceptance of revised Terms.
